Welcome to ATV Safari Langkawi. By making a booking, purchasing a package, participating in an ATV activity, or using our services, you acknowledge that you have read, understood, and agreed to the following Terms & Conditions.

These Terms & Conditions apply to all ATV Safari Langkawi packages, including Fun Trail, Escape Trail, Family Bonding, Team Building, Leadership Development, Edu-Tourism Experience, and any other activities or packages offered by ATV Safari Langkawi.

1. Booking & Reservations

  • Advance booking is highly recommended to secure your preferred date and time.

  • All bookings are subject to availability and confirmation by ATV Safari Langkawi.

  • Customers must provide accurate information, including their full name, contact number, number of participants, selected package, and other information requested during booking.

  • A booking is considered confirmed once the required payment has been successfully received and booking confirmation has been issued.

  • ATV Safari Langkawi reserves the right to reject or cancel a booking where false, incomplete, or misleading information has been provided.

  • Walk-in participation is subject to ATV and guide availability.

2. Package & Activity Information

  • Package duration stated on our website or booking platform is an estimated duration and may vary depending on weather, trail conditions, participant ability, group size, safety requirements, and operational circumstances.

  • Routes, checkpoints, activities, waterfall stops, river crossings, and other attractions may be modified when necessary for safety or operational reasons.

  • Certain activities or locations may be temporarily unavailable due to weather, maintenance, environmental conditions, government restrictions, or circumstances beyond our control.

  • ATV Safari Langkawi reserves the right to substitute a route or activity with a reasonably suitable alternative where necessary.

3. Arrival & Check-In

  • Participants should arrive at the designated meeting point at least 15–30 minutes before the scheduled activity time for registration, safety briefing, equipment preparation, and other pre-ride procedures.

  • Participants arriving late may have their activity duration shortened or may not be permitted to join the trip if the group has already departed.

  • No refund will be provided for missed activities resulting from a participant’s late arrival.

  • Participants must follow the meeting point, pickup time, and check-in instructions provided in their booking confirmation.

4. Hotel & Resort Pickup

  • Hotel or resort pickup is available only for selected packages and selected locations where specifically stated.

  • Customers must provide accurate accommodation and contact details.

  • Participants should be ready at the agreed pickup location before the scheduled pickup time.

  • Pickup and transfer times are estimates and may be affected by traffic, weather, road conditions, and other operational circumstances.

  • Failure to be present at the agreed pickup location may be treated as a late arrival or no-show.

  • Additional transfer charges may apply for locations outside the designated pickup area.

5. Participant Requirements

For the safety of all participants:

  • Participants must be physically capable of participating in the selected activity.

  • ATV drivers must be able to understand and follow safety instructions provided by our guides.

  • Participants must wear the safety equipment provided or required by ATV Safari Langkawi.

  • Participants must follow the designated trail and remain under the supervision of our guides.

  • Reckless riding, racing, dangerous overtaking, intentional drifting, or deliberately ignoring guide instructions is strictly prohibited.

  • Participants must not operate an ATV while under the influence of alcohol, illegal drugs, or any substance that may impair judgement or coordination.

  • ATV Safari Langkawi reserves the right to prevent any participant from riding if our guide considers that participant unable to operate the ATV safely.

6. Children & Young Participants

  • Children may participate only in packages or activities designated as suitable for children.

  • Age, height, weight, or other safety restrictions may apply depending on the ATV type and activity.

  • Children who are not permitted to operate an ATV independently must ride according to the passenger arrangements approved by ATV Safari Langkawi.

  • Participants under 18 years old must have permission from and, where required, be accompanied by a parent or legal guardian.

  • The final decision regarding whether a child or young participant may ride or participate rests with ATV Safari Langkawi based on safety considerations.

7. Safety Briefing & Equipment

  • All participants must attend the compulsory safety briefing before starting the ATV activity.

  • Safety helmets and other required safety equipment must be worn correctly throughout the ride.

  • Participants must follow all instructions given by ATV Safari Langkawi guides and crew.

  • Participants must not intentionally misuse, remove, or damage safety equipment.

  • ATV Safari Langkawi reserves the right to stop a participant from continuing the activity if safety instructions are repeatedly ignored.

8. Health & Medical Conditions

Participants are responsible for informing ATV Safari Langkawi before participating if they have any health or medical condition that may affect their ability to safely participate, including but not limited to:

  • Pregnancy

  • Heart conditions

  • High or low blood pressure

  • Epilepsy or seizures

  • Back, neck, or spinal conditions

  • Recent surgery or injury

  • Mobility limitations

  • Severe allergies

  • Any other medical or physical condition that may affect participation

ATV Safari Langkawi reserves the right to recommend that a participant does not participate, or to modify the participant’s activity, where there is a reasonable safety concern.

Participants with medical concerns are encouraged to obtain appropriate medical advice before participating.

9. Weather & Trail Conditions

ATV activities are outdoor adventure activities and may be affected by weather and natural conditions.

  • Activities may continue during light rain where conditions are considered safe.

  • Routes may become wet, muddy, slippery, or uneven following rainfall.

  • ATV Safari Langkawi may delay, modify, shorten, reschedule, or cancel an activity where weather or trail conditions present a safety risk.

  • Waterfall access, river crossings, or particular trail sections may be restricted when water levels or environmental conditions are considered unsafe.

  • Safety decisions made by our guides or management are final.

If ATV Safari Langkawi cancels an activity because it cannot be safely conducted, customers may be offered an alternative date, alternative activity, credit, or refund where applicable.

10. Cancellation & Rescheduling

  • Cancellation or rescheduling requests should be submitted as early as possible before the scheduled activity.

  • Cancellation eligibility and any applicable refund will be subject to the cancellation policy stated during booking.

  • Late cancellations and no-shows may result in the forfeiture of the amount paid.

  • Failure to arrive at the meeting point or pickup location at the required time may be considered a no-show.

  • Rescheduling is subject to availability.

  • ATV Safari Langkawi reserves the right to reschedule or cancel activities due to unsafe weather, trail closure, ATV maintenance, guide availability, government instructions, force majeure, or other circumstances beyond reasonable control.

11. Payment

  • Payment may be required in full or according to the payment terms displayed during booking.

  • Available payment methods may include credit/debit cards, online payment methods, bank transfer, or other payment options made available by ATV Safari Langkawi.

  • All prices are quoted in Malaysian Ringgit (RM) unless otherwise stated.

  • Customers are responsible for ensuring that payment details and booking information are correct before completing their transaction.

  • Prices, packages, promotions, and inclusions may change without prior notice. Confirmed bookings will generally follow the price and inclusions applicable at the time of confirmation unless otherwise agreed.

12. Refund Policy

  • Refunds are subject to the cancellation and refund conditions applicable to the customer’s booking.

  • No refund will normally be provided for no-shows, late arrivals resulting in a missed activity, voluntary withdrawal during an activity, or removal from an activity due to unsafe or inappropriate behaviour.

  • Where ATV Safari Langkawi is unable to provide the booked activity due to circumstances within our control, customers may be offered rescheduling, an alternative activity, credit, or a refund, as appropriate.

  • Refund processing times may vary depending on the original payment method, bank, payment gateway, or booking platform.

  • Bookings made through third-party platforms may also be subject to the cancellation and refund terms of the respective platform.

13. ATV Damage & Participant Responsibility

Participants are expected to operate all ATVs responsibly and according to the safety briefing.

  • Participants may be held responsible for damage resulting from reckless behaviour, intentional misuse, unauthorised riding, or failure to follow guide instructions.

  • Normal wear and tear or mechanical failure not caused by participant misuse will not be charged to the participant.

  • Any damage will be assessed by ATV Safari Langkawi based on the circumstances of the incident.

  • Participants must immediately report any accident, collision, mechanical issue, or damage to their guide.

14. Personal Belongings

Participants are responsible for their own personal belongings, including mobile phones, cameras, wallets, bags, jewellery, and electronic devices.

ATV Safari Langkawi is not responsible for loss, theft, water damage, mud damage, accidental damage, or damage to personal belongings during the activity, except where liability cannot legally be excluded.

Participants are encouraged to secure valuable items appropriately before starting the activity.

15. Clothing & Personal Preparation

Participants are advised to wear comfortable outdoor clothing and suitable footwear.

ATV riding may involve mud, water, dust, rain, river crossings, and uneven terrain. Clothing and footwear may become wet, muddy, stained, or damaged during the activity.

Participants should bring appropriate personal items such as a change of clothes, towel, sunscreen, insect repellent, and waterproof protection for electronic devices where appropriate.

16. Waterfall & Water Activities

Some packages may include visits to waterfalls, rivers, or other natural attractions.

  • Swimming or entering the water is undertaken at the participant’s own discretion and is subject to instructions from our guides.

  • Participants must follow all safety instructions relating to water conditions.

  • Access to waterfalls, rivers, or swimming areas may be restricted due to heavy rain, strong currents, high water levels, or other safety concerns.

  • Participants are responsible for supervising children under their care during stops at natural attractions.

17. Personal Accident Insurance

Personal Accident Insurance may be included or available as an optional addition depending on the selected package.

Where insurance is provided, coverage is subject to the terms, exclusions, limits, eligibility requirements, and conditions imposed by the relevant insurance provider.

Participants should review the applicable insurance coverage and arrange additional personal travel or accident insurance if they require broader protection.

18. Conduct & Behaviour

Participants must behave responsibly and respectfully towards guides, staff, other participants, local communities, wildlife, and the natural environment.

ATV Safari Langkawi has the right to immediately stop a participant from continuing an activity if they:

  • Endanger themselves or others

  • Deliberately ignore safety instructions

  • Operate an ATV recklessly

  • Behave aggressively, abusively, or inappropriately

  • Damage property intentionally

  • Are suspected of being under the influence of alcohol or illegal substances

Participants removed for these reasons will not be entitled to a refund.

19. Environmental Responsibility

ATV Safari Langkawi promotes responsible eco-tourism.

Participants must:

  • Stay on designated routes unless instructed otherwise by a guide.

  • Avoid disturbing wildlife or damaging vegetation.

  • Not litter along trails, rivers, waterfalls, or activity areas.

  • Follow instructions designed to protect the rainforest and surrounding environment.

20. Photography & Videography

Photographs or videos may be taken during ATV Safari Langkawi activities for operational, safety, or promotional purposes.

Where images are intended for marketing or promotional use, ATV Safari Langkawi will respect applicable consent and privacy requirements.

Participants wishing to take their own photographs or videos must do so safely and must not use mobile phones or cameras while actively operating an ATV unless specifically permitted by the guide.

21. Assumption of Risk

ATV riding is an outdoor adventure activity and involves inherent risks.

These may include uneven terrain, mud, water, slippery surfaces, changing weather, natural obstacles, collisions, falls, and other risks associated with outdoor motorised activities.

By participating, customers acknowledge the nature of the activity and agree to follow all reasonable safety procedures and instructions.

Nothing in these Terms & Conditions excludes or limits any liability that cannot lawfully be excluded under applicable Malaysian law.

22. Limitation of Liability

To the fullest extent permitted by applicable law, ATV Safari Langkawi will not be responsible for loss, injury, damage, delay, or additional expenses resulting from:

  • A participant’s failure to follow safety instructions

  • Reckless or negligent behaviour by a participant

  • Undisclosed medical or physical conditions

  • Loss or damage to personal belongings

  • Weather or natural conditions

  • Circumstances outside our reasonable control

Nothing in these Terms & Conditions is intended to exclude any rights or remedies that cannot be excluded under applicable Malaysian law.

23. Third-Party Services

Certain services, including transportation, payment processing, insurance, or bookings made through external travel platforms, may involve third-party service providers.

Where applicable, customers may also be subject to the terms and conditions of those third-party providers.

ATV Safari Langkawi is not responsible for independent third-party services except to the extent required by applicable law.

24. Privacy

Personal information collected during the booking process may be used for:

  • Booking and activity management

  • Customer communication

  • Payment processing

  • Pickup and transportation arrangements

  • Safety and emergency purposes

  • Insurance administration where applicable

  • Service improvement

  • Promotional communications where consent has been provided

Personal information will be handled responsibly and in accordance with applicable privacy and data protection requirements.

25. Force Majeure

ATV Safari Langkawi will not be responsible for failure or delay in providing services caused by circumstances beyond our reasonable control, including severe weather, flooding, natural disasters, government restrictions, road closures, trail closures, emergencies, or other unforeseen events.

Where reasonably possible, we will attempt to provide an alternative date, route, activity, or other appropriate arrangement.

26. Changes to Packages & Prices

ATV Safari Langkawi reserves the right to update package descriptions, routes, inclusions, operating hours, prices, and other service information when necessary.

Changes affecting an existing confirmed booking will be communicated to the customer where reasonably practicable.

27. Amendments to These Terms

ATV Safari Langkawi reserves the right to modify these Terms & Conditions from time to time.

The latest version will be published on our official website and will take effect from the stated effective date or, if no date is stated, upon publication.

28. Governing Law

These Terms & Conditions are governed by the applicable laws of Malaysia.

Any dispute arising in connection with our services will be handled in accordance with applicable Malaysian law and the jurisdiction of the relevant Malaysian courts.
